Is the EU Battery Directive still valid?

Accepted Answer

No. The former EU Battery Directive (2006/66/EC) has been replaced by the European Battery Regulation (EU) 2023/1542. Unlike the directive, which required implementation by individual Member States, the new regulation applies directly across the European Union. It also expands the scope from battery collection and recycling to the entire battery lifecycle, including product design, sustainability, labelling, traceability and end-of-life management.

Does the European Battery Regulation apply to imported batteries (made outside Europe)?

Yes. The European Battery Regulation applies to batteries placed on the European market, regardless of where they are manufactured. The Battery Passport is being introduced in phases and is intended to improve transparency, traceability and circularity across the battery value chain.

Can I still buy non-European batteries and remain compliant?

Accepted Answer

Yes, the EU Battery Regulation does not impose any origin requirements. A battery that meets all CE, labelling and, in future, battery passport requirements is compliant. The difference lies in who bears responsibility for compliance. If you import the battery, you are the economic operator and you bear that responsibility yourself. If you purchase from a European supplier who is already compliant, you assume their compliance.

Documentation requirements will continue to develop as further parts of the regulation become applicable.

Question 11

Does every battery need a Digital Battery Passport?

Accepted Answer

No. From February 2027, the Battery Passport requirement applies to LMT (Light Means of Transport) batteries, electric vehicle batteries and industrial batteries with a capacity greater than 2 kWh. Each applicable battery will have its own electronic passport, accessible through a unique identifier and QR code.

Question 12

Do batteries have to be replaceable under the European Battery Regulation?

Accepted Answer

Not all batteries have the same replaceability requirements. From 2027, the regulation introduces removability and replaceability requirements for portable batteries incorporated into products, while specific provisions apply to LMT (Light Means of Transport) batteries. There are also defined exceptions, so OEMs should assess the requirements during product development rather than assuming every battery must simply be removable by an end user.

Is complying with the European Battery Regulation enough to make a battery sustainable?

No. The regulation establishes legal requirements for areas including sustainability, circularity, traceability and responsible sourcing, but legal compliance should not be confused with a complete sustainability strategy. Companies can voluntarily go further in areas such as sustainable procurement, environmental management, labour and human rights, ethics and supply-chain management.
